October 20, 2006 — Eminent Domain Limit Initiative
Measure 39 prevents the government from using its eminent domain power to acquire private property for a public purpose.
This initiative was sparked by a U.S. Supreme Court ruling last year known as Kelo vs. New London. In that case, the court ruled than the city of New London, Connecticut, could take private property by eminent domain and transfer it to a private developer for public purposes-specifically economic development.
Measure 39 is designed to limit the government's use of eminent domain for a public purpose.
This week, you'll hear from both sides of this eminent domain limit measure.
