Getting Sizemore Straight


During our show with four of the Republican candidates for governor, I asked Bill Sizemore how the indictments he's facing for tax evasion and the several million dollar judgment against him in a case brought by public employee unions affect his candidacy. He grinned and said it gives him good insight into the way things work! But he also said the Oregon Supreme Court overturned the judgment against him several years ago.

Not exactly. In December, 2006, an appeals court found Sizemore was not personally liable for a $2.5 million judgment against his two organizations which were sued in 2002 for racketeering by the Oregon Education Association and the American Federation of Teachers-Oregon. In July 2008, the Oregon Supreme Court upheld the size of the judgment and the liability of the organizations, and remanded the question of Sizemore's personal liability. According to the Associated Press, he was later found personally liable, but he has put in a new motion that's related so I'm still trying to sort out what's most current.

I am not a lawyer but I do believe in free speech.  Why does it seem corporations (and perhaps large organizations) have more "free speech" rights lately than individuals (including and especially individuals such as Bill Sizemore who seems to be a favorite target)?

I like to look at primary documents and not get my news from 2 dozen news stories - even CNN gets it wrong and I've seen that.  From what I can tell the multi-million $$ suits against Sizemore have been dropped, they have since tried to get him to stop writing initiatives in exchange for stopping their lawsuits.  Is this fair?  Should an individual acquiese?
